By accessing or using Queue-Up, a platform built and operated by Fencode LLC, a company registered in New Mexico, USA, you agree to these Terms of Service and any applicable policy, guideline, or rule published within the platform. If you do not agree, you must not use Queue-Up.
You must be at least 18 years old and legally capable of entering into binding contracts to use Queue-Up. By creating an account or using the platform, you represent that you meet this requirement and that all information you provide is true, current, and complete.
Queue-Up facilitates connections between users who purchase services and Masters who offer them. Fencode LLC operates the platform infrastructure, internal payment system, and support tools, but does not guarantee specific outcomes, personal compatibility, gaming performance, continued availability of any Master, or the subjective quality of any interaction.
You are responsible for the security of your credentials, devices, and any access linked to your account, as well as all activity conducted through it. We may require additional verification, limit features, or suspend access if we detect fraud, impersonation, abuse, operational risk, or a breach of these terms.
Q-Bucks is Queue-Up's internal platform currency and may only be used within the platform for permitted services and functionality. Q-Bucks is not legal tender, does not accrue interest, is not transferable between users except where Queue-Up expressly enables it, and has no cash value outside the platform. Unless required by applicable law or expressly authorized by Queue-Up, Q-Bucks is not redeemable for money.
Charges to add balance or purchase services may be processed through Stripe or other payment providers authorized by Queue-Up. By making a purchase, you authorize the applicable charge, including taxes, processing fees, platform commissions, or other amounts disclosed before confirmation. Queue-Up may update pricing, commissions, or fee structures at any time.
Master payouts may be processed through Wise or other providers authorized by Queue-Up, and are subject to verification, risk review, holding periods, identity validation, tax requirements, and internal compliance rules. Queue-Up may delay, split, reject, or freeze a payout where there is a reasonable suspicion of fraud, dispute, chargeback, operational error, restricted activity, or a breach of these terms.
As a general rule, Queue-Up does not provide cash refunds. In limited cases and at Queue-Up's sole discretion, we may issue a partial or full credit in Q-Bucks, including for verified service failures, mistaken charges, confirmed fraud, or exceptional cancellations. Commissions, processing costs, and third-party charges may remain non-refundable even when a credit is approved.
Queue-Up may investigate cancellations, claims, chargebacks, and disputes relating to services, payments, conduct, or misuse of the platform. In doing so, we may review messages, order history, evidence submitted by the parties, and internal records. Our operational decisions regarding release, hold, reversal, refund, or adjustment of platform balances will be made at our reasonable discretion to protect users, Masters, and Queue-Up.
You must use Queue-Up lawfully, respectfully, and in good faith. Prohibited conduct includes, without limitation, harassment, discrimination, fraud, impersonation, review manipulation, payment abuse, requests for sexual or illegal content, violating third-party rules, attempting to exploit vulnerabilities, money laundering, or using the platform for purposes other than those expressly permitted.
You may not use Queue-Up to move transactions or commercial relationships off-platform in order to avoid commissions, safety controls, reviews, or internal policies. We may also take action if we detect direct payment requests, contact exchanges intended to evade platform rules, or attempts to continue services sourced through Queue-Up outside the platform.
Queue-Up, its brand, design, software, materials, and platform content belong to Fencode LLC or its licensors and are protected by applicable law. You retain rights to content you upload to the extent permitted by law, but you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use that content as reasonably necessary to operate, protect, promote, and improve Queue-Up.
We may suspend, restrict, or terminate accounts, orders, pending balances, payouts, listings, or access at any time if we believe there has been a breach of these terms, legal risk, financial risk, suspicious activity, system abuse, or a need to protect the platform or third parties. Suspension or termination does not erase prior obligations and does not guarantee any refund.
To the fullest extent permitted by law, Queue-Up is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted, error-free, secure at all times, fit for a particular purpose, or that any service, session, or interaction will meet a user's subjective expectations.
To the maximum extent permitted by law, Fencode LLC, Queue-Up, and their affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, loss of goodwill, or business interruption arising out of or related to the use of, or inability to use, the platform. In all cases, Queue-Up's total aggregate liability will not exceed the amount you actually paid to Queue-Up in the 12 months preceding the event giving rise to the claim.
We may update these terms at any time to reflect legal, operational, commercial, or technical changes. When changes are material, we may provide notice within the platform or through other reasonable means. Continued use of Queue-Up after the effective date of the changes constitutes acceptance of the updated terms.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of laws principles. Any controversy that cannot be resolved operationally or informally will be subject to the jurisdiction applicable to Fencode LLC and the operation of Queue-Up, unless mandatory law requires otherwise.
